Welcome to Dazéy Candles LLC. The terms "we," "us," and "our" refer to Dazéy Candles LLC. Dazéy Candles LLC operates this store and website, including all related information, content, features, tools, products, and services, to provide customers with a curated shopping experience (collectively, the "Services"). Dazéy Candles LLC is powered by Shopify, which enables us to provide the Services.

These terms and conditions, together with any policies referenced herein (the "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you should not access or use the Services.

Section 1 — Access and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. If you permit a minor dependent to use the Services through a device or account that you own or manage, you are responsible for that use.

To access or use certain portions of the Services, including purchasing products or services, you may be asked to provide information such as your email address and billing, payment, or shipping information. You represent and warrant that the information you provide is correct, current, and complete and that you have all rights necessary to provide it.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

Section 2 — Products and Services

We make reasonable efforts to describe and display our products and services accurately. However, colors and appearance may vary because of screen settings, lighting, photography, material availability, and the handmade nature of certain products.

Hand-poured candles, wax melts, floral arrangements, scarves, gift boxes, and other handmade, natural, seasonal, or curated products may have slight variations in color, texture, placement, packaging, or appearance. Natural soy wax can also develop cosmetic variations as temperatures change. These variations do not necessarily indicate a defect.

Fragrance perception is personal and can be affected by room size, airflow, temperature, and individual sensitivity. We do not guarantee that every fragrance will match every customer's personal preference.

Product descriptions, prices, availability, packaging, and specifications may change without notice. We reserve the right to discontinue a product or service and to limit quantities offered to any person, geographic region, or jurisdiction, on a case-by-case basis and as permitted by law.

Candle and Wax-Melt Safety

Customers are responsible for reviewing and following all product labels, warnings, instructions, and candle-care guidance. Candles must be burned within sight on a stable, heat-resistant surface and kept away from children, pets, drafts, fabrics, and flammable materials. Never move or touch a candle while the vessel or wax is hot.

Trim the wick to approximately one-quarter inch before each burn. Do not burn a candle for more than four hours at a time, and discontinue use when approximately one-half inch of wax remains in the vessel. Wax melts must be used only with a warmer intended for wax products and in accordance with the warmer manufacturer's instructions. Never add water to candle wax or wax melts.

Dazéy Candles LLC is not responsible for damage resulting from misuse, failure to follow product warnings or instructions, unauthorized alteration, or use inconsistent with a product's intended purpose. Additional guidance is available on our Candle Care page.

Digital Products

Ebooks and other digital products are delivered electronically and are licensed to the purchaser for personal, noncommercial use unless a product listing expressly states otherwise. Digital products may not be reproduced, resold, redistributed, shared, uploaded, or commercially exploited without prior written permission from Dazéy Candles LLC.

Customers are responsible for providing a valid email address and using a compatible device or application to access digital products. Because digital products cannot be physically returned, they are final sale after delivery or download except where otherwise required by law.

Flowers, Custom Orders, Wholesale Orders, and Bulk Orders

Fresh flowers, floral arrangements, personalized products, custom products, made-to-order products, wholesale orders, and bulk orders may vary based on seasonal availability, materials, quantity, and the approved design. When a specific component is unavailable, we may contact the customer to discuss a comparable substitution.

Custom, wholesale, and bulk orders may require a deposit, minimum purchase, production period, or separate agreement. Applicable pricing, payment deadlines, production timelines, cancellation terms, and delivery arrangements will be stated in the quote, invoice, order confirmation, or separate agreement. These orders are not confirmed until the required payment is received.

Approved wholesale customers may purchase designated products for authorized commercial resale. Retail purchases are intended for personal or household use and may not be purchased for unauthorized commercial resale or export.

Gift Cards

Gift cards and e-gift cards are subject to the terms presented at purchase and applicable law. They may not be redeemed for cash except where required by law. Customers are responsible for safeguarding gift-card codes. We are not responsible for unauthorized use of a gift card after delivery unless required by applicable law.

Workshops, Classes, and Events

Workshop, class, Pour & Sip, private-event, and other experience bookings are subject to the attendance, cancellation, rescheduling, age, conduct, and safety requirements displayed at booking or provided in a separate agreement. Participants must follow all safety directions from Dazéy Candles LLC and venue personnel.

An additional participation agreement, safety acknowledgment, or waiver may be required before an event. A parent or legal guardian may be required to provide consent for a minor participant. We may refuse or end participation when conduct creates a safety risk, disrupts the experience, or violates venue rules.

Section 3 — Orders

When you place an order, you are making an offer to purchase. Dazéy Candles LLC reserves the right to accept or decline an order for a lawful reason and at its discretion. An order is not accepted until we confirm acceptance, and payment must be authorized or processed before the order is accepted.

Please review your order carefully before submitting it because we may be unable to accommodate cancellation requests after processing or production begins. If we decline, modify, or cancel an order, we will attempt to notify you using the email address, billing address, or telephone number provided with the order.

Purchases, returns, exchanges, cancellations, and refunds are governed by our Returns and Refunds Policy.

Unless you have entered into an approved wholesale or resale arrangement with Dazéy Candles LLC, products purchased through our retail store are intended for personal or household use and may not be purchased for unauthorized commercial resale or export.

Section 4 — Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect when the order is placed and will appear in the order confirmation. Unless expressly stated otherwise, posted prices do not include applicable taxes, shipping, handling, customs, duties, or import charges.

Prices displayed through the Services may differ from prices offered at in-person events, physical retail locations, or third-party stores. Promotions may be governed by additional terms. If promotional terms conflict with these Terms, the promotional terms will control for that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information. You agree to promptly update your information, including your email address and payment details, so we can complete transactions and contact you when necessary.

You represent and warrant that the payment information you provide is accurate, that you are authorized to use the selected payment method, and that you will pay all authorized charges, including applicable shipping charges and taxes.

Section 5 — Shipping and Delivery

Order-processing and estimated shipping times are described in our Shipping Policy. Delivery dates are estimates unless expressly guaranteed in writing.

Carrier delays, severe weather, holidays, service interruptions, customs processing, inaccurate customer information, and other circumstances outside our reasonable control may affect delivery. If we are unable to ship an order within the timeframe originally promised, we will provide notice and available options in accordance with applicable law.

Customers are responsible for providing complete and accurate shipping information and for contacting us promptly if an error is discovered. We cannot guarantee that an address can be changed after processing or fulfillment begins.

Section 6 — Intellectual Property

The Services—including trademarks, brand elements, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement thereof—are owned by Dazéy Candles LLC, its affiliates, or licensors and are protected by applicable intellectual-property laws.

These Terms permit you to use the Services for personal, noncommercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material from the Services without prior written consent, except as permitted by law.

Nothing in these Terms grants you a license or other right to any patent, trademark, copyright, or other intellectual property of Dazéy Candles LLC, Shopify, or a third party. All rights not expressly granted are reserved.

Dazéy Candles LLC's names, logos, product and service names, designs, and slogans are trademarks of Dazéy Candles LLC or its affiliates or licensors and may not be used without prior written permission. Shopify's names, logos, product and service names, designs, and slogans are trademarks of Shopify. Other names, logos, and marks belong to their respective owners.

Section 7 — Optional Tools

We may provide access to tools offered by third parties that we do not monitor or control. Access to those tools is provided "as is" and "as available," without warranties, representations, conditions, or endorsement, to the extent permitted by law.

Your use of optional third-party tools is at your own risk and discretion. You should review and approve the third party's applicable terms before using a tool.

Future features, tools, and resources offered through the Services will also be considered part of the Services and will be subject to these Terms.

Section 8 — Third-Party Links

The Services may contain materials, links, or embedded functionality provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. If you leave the Services to access third-party materials, you do so at your own risk.

We are not responsible for harm or damages related to your use of third-party websites or your purchase or use of third-party products, services, resources, or content, to the extent permitted by law. Review the third party's policies before engaging in a transaction. Questions concerning third-party products and services should be directed to the applicable third party.

Section 9 — Relationship With Shopify

Dazéy Candles LLC is powered by Shopify, which enables us to provide the Services. However, sales and purchases made through our store are made directly with Dazéy Candles LLC. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Dazéy Candles LLC, including injury, damage, or loss resulting from purchased products or services. To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with Dazéy Candles LLC.

Section 10 — Privacy Policy

Our collection, use, disclosure, and protection of personal information are governed by our Privacy Policy.

Because our store is hosted by Shopify, Shopify may collect and process certain personal information to provide and improve the Services. Information submitted through the Services may be transmitted to Shopify and other service providers, including providers located outside the country or region where you reside, as described in our Privacy Policy.

By using the Services, you acknowledge that you have reviewed our Privacy Policy.

Section 11 — Feedback

If you submit, upload, post, email, or otherwise transmit ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any lawful purpose, including operating, evaluating, improving, and promoting the Services.

You represent and warrant that you own or have the necessary rights to your Feedback, have disclosed compensation or incentives received in connection with it, and will comply with these Terms.

We are not obligated to maintain Feedback in confidence, pay compensation for it, or respond to it. We may monitor, edit, or remove Feedback that we determine is unlawful, offensive, threatening, defamatory, obscene, objectionable, or in violation of intellectual-property rights or these Terms.

Feedback must not violate another person's copyright, trademark, privacy, publicity, personality, or other rights; contain unlawful, abusive, or obscene material; or contain malware. You may not use a false email address, impersonate another person, or mislead us about the origin of Feedback. You are responsible for your Feedback and its accuracy.

Section 12 — Errors, Inaccuracies, and Omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct errors, update information, or cancel orders affected by inaccurate information, including after an order is submitted, as permitted by law. If an order is canceled after payment, the applicable payment will be refunded.

You may access and use the Services only for lawful purposes. You may not use the Services, directly or indirectly, to:

  • Engage in unlawful or malicious activity;

  • Violate applicable international, federal, state, provincial, or local laws or regulations;

  • Infringe our intellectual-property rights or the rights of another person;

  • Send, receive, upload, download, use, or reuse material that does not comply with these Terms;

  • Transmit unsolicited advertising or promotional material, including spam or chain messages;

  • Engage in conduct that restricts another person's use of the Services, harms Dazéy Candles LLC, Shopify, or users of the Services, or exposes them to liability.

You also agree not to upload malicious code; reproduce, duplicate, copy, extract, sell, resell, or exploit an unauthorized portion of the Services; collect or track another person's personal information; spam, phish, pharm, or pretext; use robots, spiders, scraping tools, automated extraction processes, agentic artificial-intelligence tools, or other automated or manual means to access the Services in violation of posted restrictions; or bypass security, authorization, robot-exclusion, or access-control measures.

We may suspend, disable, or terminate an account or access to the Services if we reasonably determine that these Terms have been violated.

14.1 This section ("Agent Terms") applies if you use, permit, enable, or deploy an Agent to access, use, or interact with the Services. "Agent" means software or a service that takes autonomous or semi-autonomous action for, or at the instruction of, a person or entity and can operate without direct supervision.

14.2 An Agent may not access, use, or interact with the Services unless it identifies itself and operates in accordance with Section 14.4. An Agent may not access, use, or interact with the Services after we request that it stop.

14.3 We may use technical or other measures to limit whether and how an Agent accesses, uses, or interacts with the Services.

14.4 Agents must: (i) identify each HTTP or HTTPS request as originating from an Agent and disclose the Agent's name in the user-agent string in the format "Agent/[agent name]"; (ii) not conceal or obscure that access, use, or interaction originates from an Agent, including by mimicking human behavior or circumventing CAPTCHAs; (iii) respond truthfully to prompts intended to determine whether an interaction comes from a human or computer; and (iv) not avoid or circumvent measures intended to block, limit, modify, or control Agent access to the Services.

Section 15 — Termination

We may terminate this agreement or suspend or terminate access to the Services, in whole or in part, when permitted by law. You remain responsible for amounts due through the date of termination.

The provisions concerning Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Entire Agreement, Assignment, Governing Law, Privacy, and any other provisions that by their nature should survive will continue after termination.

Section 16 — Disclaimer of Warranties

Information presented through the Services is provided for general informational purposes. We do not warrant its accuracy, completeness, or usefulness. Reliance on such information is at your own risk.

EXCEPT AS EXPRESSLY STATED BY DAZÉY CANDLES LLC AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OR ALL OF THESE DISCLAIMERS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

Section 17 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DAZÉY CANDLES LLC AND ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS LIMIT OR DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, LIABILITY WILL BE LIMITED ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

Section 18 — Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Dazéy Candles LLC, Shopify, and their affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party losses, damages, liabilities, and claims, including reasonable attorneys' fees, arising from your material breach of these Terms, your violation of law or another person's rights, or your misuse of the Services.

We will provide reasonable notice of an indemnifiable claim. A delay in notice will not relieve you of your obligations unless the delay materially prejudices your defense. We may control the defense and settlement of the claim at your expense, including selection of counsel, but will not agree to a settlement imposing a nonmonetary obligation on you without your consent, which may not be unreasonably withheld. You agree to reasonably cooperate in the defense.

Section 19 — Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity or enforceability of the remaining provisions.

Section 20 — Waiver and Entire Agreement

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms and the policies or operating rules posted on the Services constitute the entire agreement between you and us regarding the Services and supersede prior or contemporaneous agreements, communications, and proposals, whether oral or written, concerning the Services.

Any ambiguity in the interpretation of these Terms will not automatically be construed against the drafting party.

Section 21 — Assignment

You may not delegate, transfer, or assign these Terms or your rights or obligations under them without our prior written consent. An unauthorized attempt to do so is void. We may transfer, assign, or delegate these Terms and our rights and obligations as permitted by law.

Section 22 — Governing Law

These Terms and any separate agreements through which we provide the Services are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be brought in a state or federal court with proper jurisdiction over the dispute and the parties, unless applicable law requires otherwise.
